9. KI-gestützte Verarbeitung im Rahmen von Audits

Art und Zweck der Verarbeitung

Im Rahmen von technischen Audits, insbesondere im Bereich Barrierefreiheit, Usability und Code-Analyse, verarbeiten wir Inhalte, die uns von Auftraggebern zur Verfügung gestellt werden (z. B. Quellcode, Konfigurationen oder strukturelle Daten von Websites und Anwendungen).

Umgang mit sensiblen und unternehmensinternen Daten

Die uns zur Verfügung gestellten Inhalte können vertrauliche oder unternehmensinterne Informationen enthalten (z. B. API-Keys, interne Bezeichnungen, Projektstrukturen, personenbezogene Daten oder andere sensible Strings).

Vor einer Weiterverarbeitung, insbesondere bei Nutzung externer Systeme, werden diese Inhalte nach Möglichkeit technisch reduziert sowie – sofern eine vollständige Anonymisierung nicht möglich ist – pseudonymisiert. Dies erfolgt insbesondere durch:

  • Entfernung oder Maskierung von personenbezogenen Daten
  • Ersetzung sensibler Inhalte durch Platzhalter oder abstrahierte Codes
  • Reduktion auf für den Analysezweck erforderliche Strukturen

Lokal betriebene KI-Systeme

Ein Teil der Analysen erfolgt unter Einsatz lokal betriebener KI-Modelle oder lokaler Entwicklungsumgebungen, z. B. über LM Studio und dort lokal ausgeführte Modelle. In diesen Fällen findet keine Übermittlung von Daten an externe Dritte statt.

Einsatz externer KI-Dienste

Sofern im Einzelfall externe KI-Dienste eingesetzt werden, erfolgt dies ausschließlich auf Grundlage der Erforderlichkeit zur Leistungserbringung, unter Beachtung der datenschutzrechtlichen Vorgaben sowie – sofern erforderlich – auf Grundlage entsprechender vertraglicher Vereinbarungen zur Auftragsverarbeitung.

Es werden dabei ausschließlich solche Daten übermittelt, die zuvor – soweit technisch möglich – anonymisiert, pseudonymisiert oder abstrahiert wurden. Eine Übermittlung von Zugangsdaten, vollständigen Datensätzen oder eindeutig identifizierbaren Informationen wird vermieden. Dies kann auch die Nutzung abstrahierter Codes für externe KI-Systeme wie etwa GPT oder Gemini umfassen, soweit dies im jeweiligen Auditfall erforderlich und datenschutzrechtlich zulässig ist.

Rechtsgrundlage

Die Verarbeitung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. b DSGVO (Vertragserfüllung) sowie – sofern einschlägig – Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an effizienter Analyse und Qualitätssicherung). Soweit wir im Auftrag unserer Kunden tätig werden und dabei personenbezogene Daten verarbeiten, erfolgt dies ausschließlich im Rahmen eines Vertrags zur Auftragsverarbeitung gemäß Art. 28 DSGVO.

Storage Duration

Die im Rahmen von Audits verarbeiteten Daten werden nur so lange gespeichert, wie dies zur Durchführung und Dokumentation des jeweiligen Auftrags erforderlich ist, sofern keine gesetzlichen Aufbewahrungspflichten entgegenstehen.

Die Verarbeitung erfolgt unter besonderer Berücksichtigung von Datenschutz, Datensparsamkeit und barrierefreier Analysemethoden.
